Below we present information related to processing your personal data, in relation to using our online store at www.encann.pl and placing orders for ENCANN products through it.
We make sure to only process your data to the extent required to achieve the goals specified below, in a manner that guarantees their full security and in line with all the provisions governing personal data processing, in particular in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, p. 1), hereinafter referred to as “GDPR” and the personal data protection act of 10th May 2018 (The 2018 Official Journal, item 1000).

What do we process the personal data of our Customers for?

Running the encann.pl website
The personal data of our Customers is processed for the purpose of providing functionality of our online store, in accordance with its terms of use. This covers in particular providing the Customers with the option to register an account on the store’s website and to place orders for our products.

Performing sales
Upon a decision to purchase our products, the Customer’s data is used for the purposes of carrying out the sales transaction. This covers in particular receiving the payment from the Customer, delivery of goods at the address specified by the Customer, issuing sales documents, as well as enabling the Customer to exercise their warranty-related rights. The personal data of our Customers may also be used for the purpose of carrying out legitimate interests of encann.pl, such as protection and pursuing of claims.

Marketing purposes
The personal data of our Customers is processed for our marketing purposes, which means in particular promoting our offer of products. We wish our Customers to have access to up-to-date knowledge on our products and achievements, and in particular for them to receive information on new products and unique offers. If the Customer agrees to it, they will receive commercial messages electronically or by phone, for the purpose of presenting the offer of our store.

What is the legal basis for processing your personal data?

Depending on the purpose of processing the personal data of our Customers, the legal basis is the circumstance that it is necessary to execute sales contracts for ENCANN products (art. 6 par. 1 item b) of GDPR) or it is a permission given by the Customer when making a purchase or registering an account for the service run at the encann.pl website (art. 6 par. 1 item a) of GDPR). The basis for processing personal data of our Customers may also be the circumstance that the processing is required for purposes arising from legitimate interests carried out by encann.pl (art. 6 par. 1 item f) of GDPR).

What data of our Customers do we process?

We only process the data provided to us by the Customers when placing an order or registering an account at the encann.pl store as well as cookie files, which are:
a) full name;
b) e-mail address;
c) phone number;
d) country;
e) address;
f) postal code;
g) city/town;
h) cookie files related to handling the order;
and in the event of running a registered business also:
i) company;
j) NIP number.

Legitimate interest

The legitimate interests that we refer to are direct marketing of own products, proper presenting of our offer, protection and pursuing of claims, protection and safety from claims by Customer or third parties.

The right to object

The Customer that data relates to has the right to object at any time to processing of their personal data for reasons related to their specific situation, when the basis for the processing is the circumstance that it is required for purposes arising from legitimate interests carried out by the data controller.
The Customer has the right to object at any time to processing of their personal data, if the personal data is processed for the purposes of direct marketing.

How long do we process personal data of our Customers?

The period for which we process personal data of our Customers depends on the purpose of processing. Which is the following:
a) registering an account at the store – for the duration of the Customer being registered – until closing the account on the website; after that period we will process the Customer’s data for the purposes related to accountability of our activities, to which we are obligated by the provisions on protection of personal data or for the duration of being obligated to process based on other provisions of law and for the duration of claims being valid, but no longer than 10 years;
b) performance of sales – for a year from the contract being executed; after that period we will process the Customer’s data for the purposes related to accountability of our activities, which we are obligated to by the provisions on protection of personal data or for the duration of being obligated to process based on other provisions of law and for the duration of claims being valid, but no longer than 10 years;
c) in case of processing personal data for the purposes arising from legitimate interests of encann.pl, the data will be processed for no more than 10 years.

Who is the recipient of Customer data?

The data on our Customers will only be forwarded to entities involved in managing the encann.pl online store and in handling the orders on ENCANN products,
which means:
a) the hosting service for our website;
b) the courier company and Polish Post delivering the ordered products;
c) the entity handling online payments;
d) the bank running the company’s bank account.
In all cases, the processing of personal data is entrusted based on adequate contracts and in a manner ensuring that the personal data will be processed only for the purposes stated above.

Using social media and search engine plugins

Our online store uses social media and search engine plugins to the extent permitted by GDPR and the personal data protection act of 10th May 2018. Social media services ensure compliance of personal data use with the provisions of law. In order to obtain detailed information, we recommend reading privacy policies of individual social media and search engine services.

Sending data to a third country or an international organization

The Customers’ data will not be sent to a third country or an international organization.

The right to access personal data

The Customer has the right to access the content of their personal data, the right to rectify it, to remove it and the right to limit the processing of it. On top of that, also the right to withdraw the consent at any time without impacting compliance with the right to process, the right to transfer data and the right to object to processing of personal data.

The right to lodge a complaint with a supervisory authority

The Customer has the right to lodge a complaint with the Chairman of the Personal Data Protection Office at ul. Stawki 2 00-193 Warsaw, when they believe that the processing of the personal data involved violates the provisions of law.

What are the consequences of the Consumer not providing personal data?

The Customer’s refusal to provide data makes it impossible to use the services of the encann.pl online store, including registering an account there and placing an order on ENCANN products.
